SEATTLE (Court TV) — Elvis may have left the building but if one taxi driver has his way, the King's spirit will live on in his cab.

Taxi driver Dave Groh was fined $30 in May when an inspector spotted him driving in a red Elvis costume. Groh lost his appeal on the fine earlier this month so now he's filed an Elvis suit lawsuit.

Late last month Groh filed a lawsuit in King County Superior Court seeking a review of the city's decision and asking the court to strike down as unconstitutional the city's ordinance requiring all cab companies to enforce a strict uniform policy.

Groh's attorney Mark K. Funke has argued that the city should not be able to regulate what someone wears if the person is not a city employee. He also claims the rule violates Groh's right to freedom of expression and speech.
